Welcome to Akawntant. By accessing or using our website and services at akawntant.review, you agree to be bound by these Terms of Service. Please read them carefully.
1.Acceptance of Terms
By creating an account or using our services, you agree to these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree to these terms, please do not use our services.
2.Description of Services
Akawntant provides an online platform for preparing for the Philippine CPA Licensure Examination (CPALE). Our services include:
- Practice questions, quizzes, and flashcards
- Mock examinations simulating the CPALE format
- Progress tracking, analytics, and readiness scores
- Personalized study plans and recommendations
- Question discussion threads
- Study groups with group chat and weekly check-ins
- Bookmarks and notes for questions
3.No Affiliation with PRC or BOA
Akawntant is an independent review platform. We are not affiliated with, endorsed by, or connected to the Professional Regulation Commission (PRC), the Board of Accountancy (BOA), or any government agency. Our practice questions are designed to help you prepare but may not reflect the exact content, format, or difficulty of the actual CPALE.
4.User Accounts
You must be at least 18 years old to create an account. By registering, you represent that you are 18 or older. To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Use a strong password (minimum 8 characters with uppercase, lowercase, and a number)
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
- Not share your account credentials with others
5.Acceptable Use
You agree not to:
- Copy, distribute, screenshot, or sell our questions, explanations, or materials without written permission
- Use automated systems, bots, or scrapers to access our services
- Attempt to interfere with or disrupt our services
- Circumvent security measures or access data you are not authorized to access
- Impersonate another user or misrepresent your identity
- Violate any applicable laws or regulations
6.Community Guidelines
When using our community features (discussions and study groups), you agree to:
6.1 Expected Behavior
- Be respectful and constructive in all interactions
- Share knowledge to help fellow examinees in their preparation
- Keep discussions relevant to exam preparation, accountancy, and related topics
- Respect the privacy of other users
6.2 Prohibited Behavior
- Harassment, bullying, or intimidation of other users
- Hate speech, discrimination, or content targeting individuals or groups
- Spam, excessive self-promotion, or commercial solicitation
- Sharing actual CPALE exam questions or claiming to have leaked exam content
- Posting misleading information that could harm other examinees' preparation
- Sharing personal information of other users without consent
7.User-Generated Content
7.1 Your Content
You retain ownership of the content you create on Akawntant (comments, messages, check-ins, and other contributions). By posting content, you grant Akawntant a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the platform solely for the purpose of operating and improving our services. We will not sell, license, or use your content for AI model training, advertising, or any commercial purpose beyond platform operation. This license is revoked upon account deletion, except for anonymized content retained under Section 13.
7.2 Content Visibility
- Discussion comments are visible to all authenticated users of Akawntant.
- Study group messages and check-ins are visible only to members of that study group.
- Your display name is shown alongside your content.
7.3 Content Responsibility
You are solely responsible for the content you post. We do not endorse or verify user-generated content. Content that explains or discusses exam topics represents the opinions of the poster, not Akawntant.
8.Content Moderation
8.1 Reporting
Users may flag content that violates these terms or our community guidelines. Flagged content is reviewed by our moderation team.
8.2 Moderation Actions
We reserve the right to, without prior notice:
- Remove or hide content that violates these terms
- Lock discussion threads to prevent further comments
- Temporarily suspend or permanently ban accounts that repeatedly violate our guidelines
8.3 Appeals
If you believe a moderation action was taken in error, you may contact us at support@akawntant.review to request a review. We will respond within 14 business days.
9.Intellectual Property
All content on Akawntant, including questions, explanations, illustrations, study materials, software, and design, is owned by us or our licensors and is protected by copyright and other intellectual property laws of the Republic of the Philippines and international treaties. You may not reproduce, distribute, or create derivative works without our written consent.
10.Fees and Paid Features
Akawntant is currently free to use. We reserve the right to introduce paid features, subscription plans, or modify which features are available at no cost at any time. If we introduce paid features:
- All applicable fees will be clearly displayed before any purchase
- We will provide reasonable notice of changes to pricing or feature availability
- Continued use of paid features requires timely payment of all applicable fees
10.1 Refunds
If paid features are introduced, refund requests must be submitted within 7 days of payment. Refunds are evaluated based on usage and circumstances and will be processed within 14 business days via the original payment method. To request a refund, contact support@akawntant.review with your account email and reason for the request.
Nothing in this section limits your rights under Republic Act No. 7394 (Consumer Act of the Philippines) or Republic Act No. 11967 (Internet Transactions Act of 2023).
11.Exam Disclaimer
Akawntant is a review and preparation tool only. We make no promises, representations, or guarantees regarding exam results, regardless of how much you use our platform. Exam success depends on many factors including your own effort, study habits, prior education, and the specific content of the exam administered by the PRC.
Our readiness scores, study plans, and recommendations are algorithmic estimates based on your activity and should not be interpreted as predictions or guarantees of actual exam performance. No content on our platform, including marketing materials, should be construed as a guarantee of passing the CPALE or any other examination.
12.Limitation of Liability
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by Philippine law, Akawntant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use our services
- Any errors or inaccuracies in our content
- Unauthorized access to your account or data
- Any outcome of the CPALE or other examination you take after using our services
13.Account Deletion
You may request deletion of your account by contacting us at support@akawntant.review. Upon receiving your request:
- Your account and personal data will be permanently deleted within 30 days of your request
- Your personal data (profile, study progress, bookmarks) will be deleted
- Discussion comments and study group messages may be retained in anonymized form (with your name removed) to preserve community content
- Any active paid features will be cancelled with no further charges
14.Termination
We may suspend or terminate your account if you violate these terms, engage in prohibited behavior, or if we determine that your use of the platform poses a risk to other users or our services. We will make reasonable efforts to notify you before or at the time of termination, except where immediate action is necessary for safety or legal reasons.
15.Changes to Terms
We may modify these terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email at least 15 days before the changes take effect. Your continued use of our services after such changes constitutes acceptance of the new terms.
16.Governing Law and Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including Republic Act No. 7394 (Consumer Act), Republic Act No. 10173 (Data Privacy Act), and Republic Act No. 11967 (Internet Transactions Act).
Any dispute arising from these terms or your use of our services shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within 30 days, either party may submit the dispute to the appropriate Regional Trial Court in Metro Manila, Philippines, which shall have exclusive jurisdiction.
17.Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
